• Confidentiality: This is the most important part. The agreement ensures that everything said in the room stays in the room. This allows everyone to speak honestly and propose creative solutions without fear that those words will be used against them later in court.
• Voluntary Participation: It confirms that you are here because you want to be. You have the right to pause or leave the process at any time if you feel it isn’t working.
• Neutrality: It clarifies that the mediator is a neutral third party. The mediator isn’t a judge, won’t take sides, and won’t give legal advice. Their job is to help you reach your own agreement.
