Understanding the “Agreement to Mediate”
Before we sit down to resolve the issues at hand, we ask all participants to sign an Agreement to Mediate. Think of this document as the “Ground Rules” for our conversation. It ensures that everyone is playing by the same set of rules so that we can focus entirely on finding a solution.
What is it?
The Agreement to Mediate is a short contract that outlines how the mediation process works. It isn’t a final settlement of your dispute; rather, it is an agreement on how we will behave and communicate during our time together.
Why is it necessary?
Without this agreement, mediation would just be an informal chat. This document provides three essential protections:
- Confidentiality: This is the most important part. The agreement ensures that everything said in the room stays in the room. This allows everyone to speak honestly and propose creative solutions without fear that those words will be used against them later in court.
- Voluntary Participation: It confirms that you are here because you want to be. You have the right to pause or leave the process at any time if you feel it isn’t working.
- Neutrality: It clarifies that the mediator is a neutral third party. The mediator isn’t a judge, won’t take sides, and won’t give legal advice. Their job is to help you reach your own agreement.
The Bottom Line: This document creates a “safe zone” where we can explore options freely, knowing that the conversation is protected and that the power to decide the outcome remains entirely in your hands.
