Why Asset Percentages and Totals are Hidden During Preparation
To all Mediators,
A critical component of our platform’s workflow is the Phase 1: Discovery lock. During this phase, parties can see each other’s Asset Names and Estimated Values, but all Percentage Splits and Claim Amounts remain private.
The Strategy:
- Objective Data First: By focusing only on identifying assets and establishing their value, we create a “shared reality” before introducing subjective demands.
- De-escalation: Seeing a “100% split” claim early on often triggers defensiveness. Hiding these splits prevents parties from forming “hard positions” before the session begins.
Your Role: As the mediator, your objective is to facilitate the mapping and valuation of assets. Please do not divulge individual split demands during the discovery phase. These will be revealed only when you, the mediator, decide the parties are ready to move into the Negotiation Phase.
